Terms of Service

1. Agreement to Terms

By accessing or using MarketPilot, you agree to be bound by these Terms of Service. MarketPilot is operated by Tradilink Africa Solution Limited (RC: 8949081).

2. Description of Service

MarketPilot is an autonomous social media marketing platform that provides AI content generation, automated posting, audience boosting, analytics, and related marketing services for businesses.

3. Subscription & Payment

• Subscriptions are billed monthly in advance
• Prices are as listed on our pricing page in USD and NGN
• Payment is due at the start of each billing period
• We reserve the right to change pricing with 30 days notice

4. Refund Policy

We offer a 7-Day Visibility Guarantee. If you are not satisfied within the first 7 days of your first payment, you may request a refund by contacting our support team on WhatsApp at +2348023131379. Refunds are subject to the following conditions:

• Request must be made within 7 days of your first payment date
• A ₦10,000 non-refundable setup and processing fee applies to all refunds
• If fewer than 15 AI posts have been generated: full refund minus the ₦10,000 setup fee
• If 15 or more AI posts have been generated: proportional refund based on unused days, minus the ₦10,000 setup fee
• Refunds are processed within 5–7 business days to the original payment method
• Boost credits already spent on third-party SMM services are non-refundable
• Accounts found to have abused the guarantee (e.g. repeated refund requests, fraudulent claims) will be permanently blacklisted from the platform

5. Cancellation Policy

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

6. Client Responsibilities

• You must provide accurate social media credentials
• You are responsible for ensuring your social media accounts comply with platform terms
• You must not use MarketPilot for illegal, harmful or spam activities
• You are responsible for the content posted on your behalf

7. Service Availability

We aim for 99% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party platforms (Facebook, Instagram, etc.) or force majeure events.

8. Limitation of Liability

Tradilink Africa Solution Limited ('MarketPilot') shall not be held liable for any indirect, incidental, or consequential damages, including but not limited to: (a) loss of revenue, data, or followers; (b) account restrictions, suspensions, or bans imposed by third-party platforms (e.g., Meta, TikTok, LinkedIn) due to the Client's prior violations, content, or misuse of the Service; (c) changes to third-party API availability or algorithms. Our total liability shall not exceed the amount paid by the Client in the three (3) months preceding the claim.

9. Acceptable Use Policy

Clients agree not to use MarketPilot to: (a) violate the Terms of Service of any connected third-party social media platform; (b) send spam, unsolicited messages, or engage in artificial engagement manipulation (e.g., botting, buying followers); (c) transmit content that is illegal, hateful, or infringes on intellectual property rights. MarketPilot reserves the right to immediately suspend or terminate accounts violating this policy without refund.

9b. Meta Platform Policy Compliance

MarketPilot operates in compliance with Meta's Platform Terms and Developer Policies. By connecting your Facebook or Instagram account, you confirm that you are the authorised administrator of those accounts and that your use complies with Meta's Terms of Service. MarketPilot is not affiliated with, endorsed by, or sponsored by Meta Platforms Inc.

10. 30-Day Visibility Guarantee Terms

The '30-Day Visibility Guarantee' is strictly defined as an increase in measurable post reach and impressions. It is explicitly void if the Client fails to connect their social media accounts within 48 hours of signup, fails to provide necessary brand assets, or if the connected social media account is restricted by the platform provider.

11. Intellectual Property

MarketPilot and all related technology is the intellectual property of Tradilink Africa Solution Limited. You retain ownership of your brand content and social media accounts.

12. Affiliate Programme

MarketPilot operates a voluntary affiliate referral programme. By joining the programme, you agree to the following:

• No cost to join. Participation is free. We will never charge affiliates any fee to join, remain in, or earn from the programme.
• Commission basis — first payment only. Affiliates earn a one-time 10% commission on the referred client's first confirmed payment only. No commission is owed on renewals, subsequent billing cycles, free trials, cancelled orders, or chargebacks.
• Our liability is capped at actual earnings. Tradilink Africa Solution Limited's total financial obligation to any affiliate shall never exceed the commission actually earned and confirmed on that affiliate's dashboard. We are not liable for any indirect, speculative, or projected earnings.
• No guaranteed income. Participation in the affiliate programme does not guarantee any level of earnings. Commission rates, programme terms, and eligibility criteria may be updated with 14 days' notice.
• Programme modification or termination. We reserve the right to modify commission rates, pause, or terminate the affiliate programme at any time. Affiliates will be notified via email. Any commissions already confirmed and due at the time of termination will be honoured.
• Affiliate conduct. Affiliates must not make false or misleading claims about MarketPilot, engage in spam, or use paid advertising that impersonates MarketPilot without prior written consent. Violation results in immediate removal and forfeiture of unpaid commissions.
• Tax responsibility. Affiliates are solely responsible for declaring and paying any taxes applicable to their commission earnings under the laws of their jurisdiction. MarketPilot does not withhold tax on behalf of affiliates.
• Fraud prevention. Self-referrals, fake accounts, or any attempt to fraudulently generate commissions will result in permanent account termination and forfeiture of all pending commissions.

13. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in Nigerian courts.
